TERMS & CONDITIONS OF USE

The Legal Advice and Assistance Helpline has been established by the Newsquest Group, in association with Lloyd Green Solicitors and their Affiliates, to provide the readership of its titles with an opportunity to obtain free, preliminary advice and assistance on a broad range of civil legal matters which may be of concern to them. The Helpline is there to provide just that – initial help and advice, in an age when publicly-funded legal aid is simply no longer available in most matters! It is not there just to provide estimates, although any solicitor will happily give you an indication of costs, once they have established what the problem is, and whether it is worth your while (and theirs) proceeding. It may be that your costs can be funded by insurance, or under what is known as a conditional fee agreement, or the damage based agreements which are being introduced in April.

All calls to the Helpline are charged at the normal provider rates, without premium to Newsquest, Lloyd Green or its Affiliates, and are subject to the following terms and conditions of use:

1) By using the Helpline you agree to be bound by these terms and conditions of use which shall exclusively govern your relationship with Newsquest, Lloyd Green and their Affiliates.

2) Your use of the Helpline and any dispute which may arise in consequence of any enquiry to it shall be governed by English law, and subject to the sole jurisdiction of the English Courts.

3) When you call the Helpline we will need to establish the general nature of the matter upon which you are seeking advice, in order that we can put you through to someone who has particular knowledge or experience of matters of that nature. We will let you know the name of the person we are putting you through to, the Affiliate with whom they practice, and where they are located. Unless the matter is highly specialised, or can be professionally dealt with irrespective of location, we will always try and put you through to a practitioner within your locality. In turn, we will need your name and contact details. Where the practitioner is dealing with another caller or matter, they will endeavour to call you back same day. You can specify a particular time if you wish.

4) Legal Problems can be complex on first hearing, and it is often necessary to seek a client’s fuller instructions following a preliminary telephone discussion on the matter. Accordingly any advice which you may be given when contacting the Helpline is for provisional purposes only, and shall not constitute unqualified legal advice of any description.

5) Neither Newsquest nor Lloyd Green Solicitors or its Affiliates warrant or make any representations of whatsoever nature, whether express or implied, as to the currency, accuracy or completeness of any initial advice or other information which you receive. Any reliance which you may seek to place on such advice or information is entirely at your own risk and should be verified by fully-instructed professional advisors before taking or failing to take any action in consequence.

6) Each matter may be particular upon its own facts, which you may not have fully disclosed to us during a short telephone call, and you will need to seek specific and properly qualified advice on the basis of detailed and fuller instruction.

7) Accordingly, we shall not be liable for any loss or damage including but without limitation indirect or consequential loss or damage, howsoever arising, loss of profits or rights of action which may be claimed in consequence of your use of and reliance upon the preliminary advice and information which you receive from the Helpline.

8) Any advice or information which you are provided with shall be true and accurate to the best of the knowledge of the person providing that advice or information. Lloyd Green Solicitors shall not be responsible for any advice or assistance which you receive from any other firm of solicitors. No contractual relationship shall arise with us or any Affiliate, unless and until you enter into terms of retainer. Your contract is solely with the solicitor whom you subsequently instruct.

9) Lloyd Green and its Affiliates finance provision of the Helpline, and deal directly with all enquiries. Advice is not provided by anonymous, unqualified call centre staff. Where any reader subsequently instructs Lloyd Green Solicitors or an Affiliate, a contribution towards the costs of financing the promotion and publication of the Scheme is made to the Newsquest Group. The amount of that contribution depends upon the nature and significance of the instruction, and is disclosed in the terms of retainer offered to that client. This helps the Scheme fund the majority of enquiries where there is no need for or which do not result in instruction. Sometimes, a simple call is enough to provide peace of mind. This expense comes out of our pockets, not yours; does not add in any way to the cost of instructing us or any Affiliate.
